Terms of Service

The Service

Moment Letters lets a page creator set up a tribute or reflection page for an honoree or featured subject — for a birthday, retirement, milestone, workshop, training event, or similar occasion. Contributors (people who know or have worked with the honoree) can send letters, voice notes, video messages, and photos, which the honoree or creator can view privately. The platform is used for both personal celebrations and professional testimonial collection.

Eligibility and Accounts

You must be at least 16 years old to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly at info.capturecraft@gmail.com if you suspect unauthorized use.

Acceptable Use

You agree to use the Service only for genuine tribute, celebration, or testimonial-collection purposes. You may not:

• Use the Service for spam, harassment, bullying, threats, or impersonation.
• Upload content that is unlawful, defamatory, obscene, hateful, or infringes anyone’s rights.
• Create tribute or reflection pages targeting a person without a legitimate, good-faith celebratory or testimonial purpose.
• Upload malware, attempt to breach security, scrape the Service, or interfere with its operation.
• Resell or commercially exploit the Service except as expressly permitted.

We may remove content or suspend pages that violate these rules.

Authenticity of submissions: All contributions must be genuine. You may not submit fabricated, incentivized, or misleading testimonials or reflections. If you received any form of compensation or incentive in connection with your submission, you must disclose this clearly within your content.

Content Ownership and License

Submitters own the content they create. By submitting content to a tribute page, you grant NS Trainings a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content for the purpose of operating the relevant tribute page and providing the Service. This license lasts for as long as the content remains on the page and ends when the content or page is deleted.

Tribute creators are responsible for the pages they create and for ensuring they have the right to invite contributions and display them.

By submitting content (including voice notes, videos, and photos), you represent and warrant that you hold the necessary rights, licenses, or permissions to submit that content and to grant the license above, and that your submission does not infringe any third party’s intellectual property, privacy, or publicity rights. If your submission includes your own voice, image, or likeness, you additionally grant NS Trainings a royalty-free license to use these solely for assembling and displaying the tribute slideshow or reflection collection to the honoree and page creator.

If you wish to remove content you previously submitted, email info.capturecraft@gmail.com with the tribute page URL and a description of the content. We will action your request within a reasonable time.

Honoree and Subject Consent

The page creator is responsible for having the appropriate consent or authorization to create a page featuring, celebrating, or collecting testimonials about another person (the honoree or subject). The honoree or subject does not need an account with us, but the creator represents that they have a legitimate purpose and, where required, permission to feature that person. If you believe a page has been created about you without your authorization, contact us at info.capturecraft@gmail.com and we will review and take appropriate action, including removal if warranted.

Reply Emails and Email Consent

When contributors submit content, they may optionally consent to receive a personal reply from the honoree via email. By checking the reply consent checkbox, contributors grant the honoree (via the platform) the ability to send them one or more personal reply emails through our email service provider. Contributors may withdraw this consent at any time by contacting us. The platform does not send unsolicited marketing emails to contributors — any emails sent through the reply feature are initiated by the page creator or honoree, not by Moment Letters.

Plans, Limits, and Page Duration

The Service is offered in the following tiers:

When a page reaches the end of its duration, the page and its associated content may be deactivated and deleted. We recommend downloading anything you wish to keep before expiry.

Payments

All payments are processed by Polar.sh, our third-party payment processor. NS Trainings does not store your full payment card details. Your purchase is also subject to Polar.sh’s terms. Prices are in U.S. dollars. Recurring Trainer subscriptions renew automatically until cancelled. For refunds, see our Refund Policy.

Some tribute pages may also accept optional donations processed by PayPal. Donations are between you and the page creator; NS Trainings does not receive or hold donation funds. Donation payments are subject to PayPal’s terms.

Platform Availability

We work to keep the Service available, but we provide it on an “as is” and “as available” basis.

• Free tier: provided with no uptime guarantee.
• Paid tiers: we use commercially reasonable best efforts to maintain availability, but we do not guarantee uninterrupted or error-free service.

Suspension and Termination

We may suspend or terminate your account or any tribute page if you violate these Terms or where required by law. You may stop using the Service and request deletion of your account at any time by contacting us. Sections that by their nature should survive termination will continue to apply.

Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, NS Trainings and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, goodwill, or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve (12) months before the event (or, if you used a free plan, USD $50).

Indemnification

You agree to indemnify and hold harmless NS Trainings from claims, damages, and expenses arising out of content you submit or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. You agree that any disputes will be resolved in the state or federal courts located in Colorado.

Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to info.capturecraft@gmail.com with: (1) identification of the copyrighted work, (2) identification of the infringing content and its location on the Service, (3) your contact information, (4) a statement of good-faith belief that the use is unauthorized, and (5) a statement under penalty of perjury that the information is accurate and you are authorized to act. We will respond and, where appropriate, remove infringing content.

Changes to These Terms

We may update these Terms from time to time. We will post the revised version with a new “Last updated” date. Continued use after changes take effect constitutes acceptance.
